nanodot Terms of Service
Version 1.0
Effective date: 2 October 2026
PLEASE READ CAREFULLY. If you live in the United States, Section 19 (Dispute resolution) contains a binding individual arbitration clause and a class-action waiver that affect your legal rights. You may opt out of arbitration within 30 days, as described in Section 19.4.
1. Definitions
In these Terms:
- "nanodot," "we," "us" means Marian Paraschiv, an individual doing business as nanodot.
- "You" means the person who uses the Service.
- "Service" means the Dust app for iPhone and Apple TV, the website at nanodot.app and its subdomains (including the song shelf, Dust Live, Dust Storm, song pages, embeds, and the Spotify playlist page), our APIs, and all features and content we provide through them.
- "Your Content" has the meaning given in Section 6.1.
- "Song key" means the key we give you when you add a song (Section 5).
2. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you and nanodot and govern your use of the Service. By downloading the app, visiting the website, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy at https://nanodot.app/privacy. If you do not agree, do not use the Service.
3. Eligibility
You may use the Service only if:
- you are at least 13 years old, or older if your country requires a higher age to use online services without a parent's consent (for example, 16 in some countries of the European Economic Area);
- if you are under 18 (or the age of majority where you live), a parent or legal guardian has reviewed and agreed to these Terms;
- you are not prohibited from using the Service under U.S. export-control or sanctions laws (Section 18); and
- you comply with these Terms and all laws that apply to you.
The Service is available worldwide, but we make no promise that it is appropriate or lawful everywhere. You are responsible for complying with the law where you use it.
4. The Service
nanodot is a music visualiser. You play songs from a public shelf, and a cloud of light dances to each one. You can add your own songs, comment on songs, join Dust Live (a shared listening room with a chat), make a Dust Storm, share songs and clips, and dance a Spotify playlist on the website.
The Service is free. There are no accounts and no sign-in. We may add, change, limit, or remove features at any time, including how many songs can be added, and we may suspend or discontinue the Service, in whole or in part, without notice.
5. Your song key
When you add a song, we give you a song key. The key is shown once; we keep only a hash of it, so we cannot show it to you again. Whoever holds the key can fix that song's lyrics, remove the song, comment, chat and queue songs in Dust Live under that song's artist name, and edit or delete what that key wrote. Treat it like a password: keep it private, and don't share it. You are responsible for what is done with your key. If you lose it, or think someone else has it, contact us (Section 24).
6. Your Content
6.1 Definition
"Your Content" means everything you submit through the Service, including song audio files, artist names, links, lyrics, comments, Dust Live chat lines, queued songs, and reports.
6.2 Your Content is public
Songs, artist names, links, lyrics shown in a song's visuals, comments, and chat lines are public. Anyone can see, play, link to, embed on other websites, and share them, and others may record or share what they see. Do not submit anything you are not willing to make public.
6.3 Ownership
You keep all of your rights in Your Content. These Terms do not transfer ownership of Your Content to us.
6.4 License to nanodot
You grant nanodot a worldwide, non-exclusive, royalty-free, sublicensable (only to our service providers) license to host, store, copy, convert, transcode, analyse (including with the AI providers identified in our Privacy Policy), publicly perform, stream, publicly display, distribute, and make derivative visualisations of Your Content — such as dances, illustrations, previews, link images, and short clips — solely to operate, promote within the Service, improve, and provide the Service, including through shares and embeds of your songs.
This license ends for an item of Your Content when it is removed from the Service, except (i) for copies already shared or embedded by others, (ii) for routine backups overwritten in the ordinary course, (iii) where we must keep it by law or for moderation, and (iv) as described in Section 6.6.
6.5 Your promises about Your Content
You represent and warrant that:
- you own, or have every right and permission needed, to submit Your Content and to grant the license in Section 6.4 — for a song, this means the rights in both the sound recording and the underlying musical work and lyrics, including the right to make it publicly available for streaming;
- Your Content, and our use of it as these Terms allow, does not infringe or violate anyone's copyright, trademark, privacy, publicity, or other rights, or any law; and
- the artist name you use is yours or one you are authorised to use, and does not impersonate anyone.
Do not add music you do not have the rights to share. We may remove any song at any time, including on a copyright complaint (Section 13).
6.6 Generated visuals
The illustrations, shapes, dances, and other visuals the Service generates for a song are part of the Service and belong to nanodot (to the extent they are protectable). Generated illustrations may continue to appear in the Service's shared library, including in other songs' dances, after your song is removed. They do not contain your audio.
7. Content and conduct rules
We have zero tolerance for objectionable content and abusive users. You agree not to, and not to try to:
- submit content that is unlawful, infringing, defamatory, obscene, pornographic, or sexually explicit; that sexualises or endangers minors; or that is hateful, harassing, bullying, threatening, or violent, or that promotes self-harm, terrorism, or illegal activity;
- harass, threaten, impersonate, or dox anyone, or post anyone's personal information;
- spam, flood the chat or comments, or post advertising or scams;
- upload anything that is not music, or audio containing other people's private conversations or personal information;
- add music you do not have the rights to share (Section 6.5);
- obtain, guess, share, or use a song key that is not yours;
- evade a mute or ban, including by adding songs to obtain new keys;
- circumvent limits on uploads, songs, connections, or requests, or use the Service in a way designed to run up its costs;
- scrape, crawl, or bulk-download the Service or its content, or use bots or automation against it, except search-engine indexing that follows our robots.txt;
- introduce malware, or interfere with or disrupt the Service, its security, or other people's use of it;
- gain unauthorised access to the Service or the systems behind it;
- reverse engineer, decompile, or derive the source code of the Service, except where the law forbids this restriction;
- use the Service or its outputs to train or develop a machine-learning model; or
- use the Service to break any law or anyone's rights.
8. Moderation, reporting, and enforcement
We may — but are not required to — monitor, review, and remove any content, and we may mute or ban any song key, remove songs, or block access to the Service, at any time and without notice, if we believe content or conduct breaks these Terms or the law, or puts the Service, its users, or others at risk.
In Dust Live, anyone holding a key can report another participant. Reports are reviewed by an automated system that uses an AI provider (described in our Privacy Policy) and may result in the reported key's chat lines being deleted and the key being permanently banned from Dust Live. To report a comment, a song, or anything else, or to appeal a ban, email support@mavster.ai with a link to the content and why you are reporting it. We aim to act on reports of objectionable content within 24 hours, removing the content and banning the key responsible where it breaks these Terms.
We are not responsible for content that other people submit, and we do not endorse it.
9. AI features
The Service uses third-party AI providers to transcribe songs, write titles and notes about them, generate their visuals, and review reports. AI output can be wrong — lyrics may be misheard, titles mis-cleaned, and visuals unsuitable. You can correct a song's lyrics with its key. AI output is not professional advice of any kind.
10. Third-party services
The Service works alongside third-party services, including Apple's App Store, Spotify, and the places you share songs to (such as X). When you use them, you are responsible for following their terms. The Spotify playlist page captures the sound of a browser tab you choose, inside your own browser, only to make it dance; it does not download or save songs, and you must not use the Service to copy, record, or redistribute music from Spotify or any other service. We are not responsible for third-party services, their content, or their availability.
11. Our intellectual property and your license to use the Service
The Service — including its software, engine, visuals, designs, text, and the nanodot and Dust names and logos — belongs to nanodot and its licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment. No other rights are granted.
You may share links to songs, and the clips the Service makes for sharing, on social media and elsewhere, as long as you do not alter our branding or suggest that we endorse you.
If you send us feedback or ideas, we may use them for any purpose without obligation to you.
12. Apple App Store terms
If you got the app from Apple's App Store, these additional terms apply:
- These Terms are between you and nanodot only, not Apple. nanodot, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support for the app.
- To the maximum extent permitted by law, Apple has no warranty obligation whatsoever with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app.
- nanodot, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer-protection, privacy, or similar laws.
- If a third party claims that the app or your possession or use of it infringes their intellectual-property rights, nanodot, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints, or claims about the app go to nanodot at the address in Section 24.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
13. Copyright complaints
We respect intellectual-property rights and remove songs and other content that infringe them. If you believe content on the Service infringes your copyright, send a written notice to our copyright contact that includes:
- a physical or electronic signature of the copyright owner or a person authorised to act for them;
- identification of the copyrighted work claimed to be infringed;
- identification of the material claimed to be infringing, with enough information for us to find it (for example, the song's link on nanodot.app);
- your contact information (address, telephone number, and email);
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

If you believe content you added was removed by mistake, you may send a counter-notice with the elements required by 17 U.S.C. §512(g). We will remove content of, and ban the keys of, repeat infringers in appropriate circumstances. Knowingly false statements in a notice or counter-notice may expose the sender to liability under 17 U.S.C. §512(f).
14. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT CONTENT WILL BE STORED OR KEPT AVAILABLE, OR THAT AI OUTPUT OR USER CONTENT WILL BE ACCURATE OR APPROPRIATE. YOU USE THE SERVICE AT YOUR OWN RISK.
The visuals include rapid movement and flashing light. If you are sensitive to flashing lights, use caution.
The rights described in Section 21 are not limited by this Section.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- NANODOT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THEIR POSSIBILITY; AND
- NANODOT'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED US $50.
The rights described in Section 21 are not limited by this Section.
16. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless nanodot from third-party claims, and the resulting damages, liabilities, costs, and expenses (including reasonable attorneys' fees), to the extent arising out of (1) Your Content, including any claim that it infringes someone's rights; (2) your breach of Sections 6.5, 7, or 18; or (3) your fraud, gross negligence, or willful misconduct. This Section does not require you to indemnify nanodot for claims caused by nanodot's own breach, fraud, gross negligence, or willful misconduct.
17. Suspension and termination
You may stop using the Service at any time, and you may remove your songs and comments with your song key, as described in our Privacy Policy. We may suspend or end your access to the Service, mute or ban your keys, or remove Your Content at any time under Section 8. Sections 6.3, 6.5, 6.6, 9, 11, and 13 through 23 survive termination.
18. Export and sanctions
You represent that you are not located in, ordinarily resident in, or a national of any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. restricted-party list, including the U.S. Treasury Department's Specially Designated Nationals List and the U.S. Commerce Department's Denied Persons and Entity Lists.
19. Dispute resolution for U.S. users — individual arbitration; class-action waiver
This Section 19 applies only if you live in the United States.
19.1 Informal resolution first
Before starting arbitration, you or we must send the other a written Notice of Dispute describing the claim and the relief sought. Notices to nanodot go to support@mavster.ai (and may also be mailed to 2120 W Spring Creek Pky, Plano, TX 75023). The parties will try in good faith to resolve the dispute for 60 days before starting arbitration. Statutes of limitation are paused during this period.
19.2 Binding individual arbitration
Any dispute arising out of or relating to these Terms or the Service that is not resolved under Section 19.1 will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this Section. Arbitration will be in English, in the U.S. county where you live, or by video at your choice. The arbitrator may award any individual relief a court could award. nanodot will pay administrative and arbitrator fees to the extent the AAA's rules or applicable law require.
19.3 Class-action and jury waiver
You and nanodot each waive the right to a jury trial and to participate in any class, collective, consolidated, or representative proceeding, except for requests for public injunctive relief that cannot lawfully be waived. If a court finds this waiver unenforceable as to a claim, that claim will be decided in court under Section 20, and all other claims will remain in arbitration.
19.4 30-day right to opt out
You may opt out of Sections 19.2 and 19.3 by emailing support@mavster.ai with the subject line Arbitration Opt-Out within 30 days of the day you first use the Service (or of any later change to this Section), stating your name and that you wish to opt out of arbitration.
19.5 Small claims and intellectual property
Either party may bring an individual claim in small-claims court if it qualifies. Either party may seek temporary injunctive relief in court to protect its intellectual-property rights pending arbitration.
20. Governing law and venue
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply. For any matter not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Texas — except that if you are a consumer in the European Economic Area, the United Kingdom, or Switzerland, you may also bring proceedings in the courts of the country where you live, and you keep the protection of that country's mandatory consumer laws.
21. Consumer rights preserved
Nothing in these Terms limits, excludes, or modifies (1) consumer rights or remedies that cannot be waived under the law that applies to you; (2) liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence; or (3) any liability that cannot be limited by law. If a provision is unenforceable as to you, it will be changed only as much as needed to make it enforceable, and the rest of these Terms will stay in effect.
22. Changes to these Terms
We may update these Terms. We will post the updated Terms with a new version number and effective date on nanodot.app. For material changes — for example, to dispute resolution, liability, or how we use Your Content — we will post a prominent notice on the website and in the app at least 30 days before the change takes effect. Continuing to use the Service after a change takes effect means you accept it. If you do not agree, stop using the Service and remove Your Content.
23. Miscellaneous
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and nanodot about the Service.
No waiver. Not enforcing a provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, reorganisation, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
No agency. These Terms create no agency, partnership, or employment relationship.
